1. What is DS-260 (Consular Processing)?

If the foreign worker is outside the United States, the final step to obtain a Green Card is through Consular Processing, which involves filing Form DS-260 (Immigrant Visa Application) with the U.S. Department of State.
This process allows the foreign worker to attend an interview at a U.S. Embassy or Consulate in their home country and receive an immigrant visa to enter the U.S. as a permanent resident.

2. Steps in the DS-260 Process:
A. Approval of Form I-140
Your U.S. employer files Form I-140 (Immigrant Petition for Alien Worker) with USCIS. Once approved, and if you are outside the U.S., your case is forwarded to the National Visa Center (NVC) for further processing.


B. National Visa Center (NVC) Processing
The NVC assigns a case number and sends instructions for the next steps, including fee payments and document submissions. You’ll receive guidance on completing the DS-260 form and preparing for your visa interview.


C. Completing the DS-260 Form
Access the DS-260 form through the Consular Electronic Application Center (CEAC) using your NVC case number. Provide accurate information about your personal details, employment history, and background. After submission, print the confirmation page for your records.


D. Gathering Supporting Documents
Collect and submit required civil and financial documents, such as:

  • Valid passport
  • Birth certificate
  • Police clearance certificates
  • Marriage certificate (if applicable)
  • Evidence of financial support

Ensure all documents are translated into English if necessary.

 

E. Medical Examination
Schedule a medical exam with an authorized physician approved by the U.S. embassy or consulate. The exam results are sent directly to the embassy or consulate or provided to you in a sealed envelope to bring to your interview.


F. Visa Interview
Attend the visa interview at the designated U.S. embassy or consulate. Bring all original documents, the DS-260 confirmation page, and any additional requested materials. The consular officer will assess your eligibility and may ask questions about your application and background.


3. Processing Time
The timeline for consular processing can vary based on individual circumstances and the workload of the NVC and the U.S. embassy or consulate. Generally, the process from I-140 approval to visa issuance can take several months. Delays may occur due to incomplete documentation, administrative processing, or other factors.


Alternative: Adjustment of Status (Form I-485)
If the foreign worker is already in the U.S. under a valid status, they may apply for a Green Card through Adjustment of Status by filing Form I-485 with USCIS instead of DS-260. This is common for students, workers, or spouses already lawfully present in the U.S.
